The following Terms of Service (hereinafter, “Terms”) govern your access to and use of the Lighthouse Creativity (“Lighthouse Creativity,” “LC,” “we,” “our,” or “us”) website located at www.lighthousecreativity.com, together with related pages, materials, content, communications, accounts, products, opportunities, and services made available by Lighthouse Creativity (collectively, the “Services”).

1. Acceptance of the Terms
 
Your access to or use of any part of the Services constitutes your acceptance of the Terms. Any person who does not agree to the Terms must discontinue access to and use of the Services. Use of the Services on behalf of another person, student, parent, school, institution, company, or organization constitutes a representation that proper authority exists to act for and bind that person or entity.

2. Nature of the Services; No Client Relationship; No Guaranteed Outcome

Lighthouse Creativity provides educational information, educational guidance, informational materials, website content, communications, and related support. Website content is provided for general informational and educational purposes only.


Access to the website, submission of an inquiry, receipt of informational materials, or exchange of preliminary communications does not by itself create a formal client relationship, advisory relationship, educational placement relationship, partnership, agency relationship, or contractual obligation unless Lighthouse Creativity separately confirms such a relationship in writing.


No promise, warranty, or guarantee is made regarding any specific result or outcome. Included among non-guaranteed matters are admissions decisions, grades, test scores, recommendation outcomes, research placements, internships, scholarships, academic awards, employment results, business outcomes, and any other academic, extracurricular, or professional result.


Any student work, guidance, review, feedback, or support provided through the Services must be used lawfully and honestly. Lighthouse Creativity does not authorize or endorse fabrication of achievements, false authorship, plagiarism, academic dishonesty, admissions fraud, or professional misrepresentation.


3. Eligibility


The Services are intended for adults and for minors acting with the knowledge, permission, and involvement of a parent or legal guardian. Any user who is not legally permitted to provide valid consent under applicable law may access or use the Services only with parental or guardian authorization and supervision. A parent or legal guardian who permits a minor to access or use the Services accepts responsibility for the minor’s conduct, submissions, communications, and compliance with the Terms.


4. Privacy Policy


Access to and use of the Services are also subject to the Privacy Policy published on the website. The Privacy Policy forms part of the overall terms governing the Services.


5. Acceptable Use


Access to and use of the Services must occur only in a lawful, proper, and authorized manner. The following conduct is prohibited :


A. Improper or unlawful conduct
Use of the Services for fraud, deception, harassment, abuse, unlawful activity, or any otherwise improper purpose is prohibited.


B. False or incomplete information
Submission of inaccurate, false, misleading, or incomplete information is prohibited.


C. Misrepresentation of identity or affiliation
Impersonation of another person or entity, or false representation of identity, position, relationship, authority, or affiliation, is prohibited.


D. Academic, admissions, or professional misconduct
Use of the Services, materials, or communications to fabricate achievements, misstate authorship, support plagiarism, facilitate academic dishonesty, engage in admissions fraud, or create false or misleading academic, extracurricular, research, or professional records is prohibited.


E. Harmful code and technical interference
Uploading, transmitting, introducing, or distributing malware, malicious code, viruses, or other harmful technologies designed to disrupt, damage, disable, or interfere with the Services or related systems is prohibited.


F. Unauthorized access or disruption
Attempts to access restricted areas, interfere with operations, overload systems, disrupt servers or networks, or gain unauthorized access to any part of the Services are prohibited.


G. Automated extraction or collection
Scraping, crawling, harvesting, extracting, copying, or collecting content or data from the Services through bots, scripts, automated tools, or similar methods without prior written permission is prohibited.


H. Reverse engineering or technical derivation
Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the code, structure, architecture, or technical components of any part of the Services is prohibited, except to the extent a restriction is unenforceable under applicable law.


I. Violation of third party rights
Posting, uploading, submitting, or transmitting content that infringes, violates, or misappropriates intellectual property rights, privacy rights, publicity rights, contractual rights, or other legal rights of any person or entity is prohibited.
Violation of this Section may result in restriction, suspension, or termination of access, in addition to any other remedies available under the Terms or applicable law.


6. User Accounts


Certain parts of the Services may require creation of an account, login credentials, or other access controls.


Any user who creates or uses an account is responsible for maintaining the confidentiality and security of login credentials and for all activity occurring under the account. All registration and account information must remain accurate, current, and complete. Lighthouse Creativity must be notified promptly in the event of suspected unauthorized access, misuse, or compromise of an account.


Lighthouse Creativity reserves the right to suspend, restrict, disable, or terminate any account that contains inaccurate information, violates the Terms, creates legal or operational risk, or is used in a manner inconsistent with the Services.


7. User Content


“User Content” includes essays, personal statements, resumes, forms, files, documents, messages, submissions, attachments, drafts, images, and any other materials transmitted, uploaded, submitted, or otherwise provided through the Services. Ownership of User Content remains with the original owner to the extent ownership rights exist.


By submitting User Content, a non-exclusive, royalty free, worldwide license is granted to Lighthouse Creativity to access, review, use, store, reproduce, process, and modify User Content to the extent reasonably necessary to provide the Services, communicate with the user, maintain records, protect operations, improve internal workflows, and support legitimate business functions.


Each user submitting User Content represents and warrants that all necessary rights, permissions, and authority exist for the submission and use of the User Content, and that no law or third party right is violated by the submission. Lighthouse Creativity is not responsible for verifying the factual accuracy, legality, originality, or ownership of User Content supplied by any user.


8. Payments and Billing


Certain Services may be offered in exchange for fees, charges, or other payment obligations. Any person purchasing, ordering, or requesting a paid Service agrees to provide valid, complete, and current billing and payment information and authorizes Lighthouse Creativity, or any payment processor acting on Lighthouse Creativity’s behalf, to collect applicable fees, taxes, and related charges.


Unless a specific price is separately confirmed in writing for a specific Service, Lighthouse Creativity reserves the right to change or revise pricing at any time. In the event of payment failure, payment rejection, payment reversal, inability to verify payment authorization, chargeback, or other payment processing issues, Lighthouse Creativity may delay, suspend, decline, or cancel the affected Service.


9. Refund Policy


Except where otherwise expressly stated in writing or where applicable law requires otherwise, all payments are final and non-refundable for any reason or circumstance whatsoever.


If Lighthouse Creativity fails to complete delivering a paid service or product, or whichever object intended, within a clearly stated turnaround period expressly promised in writing by Lighthouse Creativity, and the delay is solely attributable to Lighthouse Creativity, Lighthouse Creativity may, without certainty or guarantee, issue a partial refund or service credit after review of the circumstances.


No responsibility is accepted for indirect losses, missed opportunities, admissions consequences, business consequences, or other downstream effects arising from delay.


10. Circumvention of Fees


If Lighthouse Creativity introduces a user to any member of its organization, consultant, instructor, contractor, affiliated expert, or other service provider through the Services, the user may not use that introduction to avoid, bypass, or evade fees that would otherwise apply through Lighthouse Creativity.


In the event of circumvention, Lighthouse Creativity reserves the right to pursue recovery of the applicable unpaid amount together with reasonable administrative, investigative, legal, and enforcement costs to the extent permitted by law.


11. Intellectual Property Rights


All content, branding, frameworks, worksheets, guides, downloads, videos, images, graphics, text, logos, design elements, layouts, and other materials made available through the Services are owned by Lighthouse Creativity or used under valid license, and are protected by applicable intellectual property and proprietary rights laws.


No reproduction, distribution, publication, republication, sale, licensing, modification, extraction, display, transmission, or creation of derivative works is permitted without prior written authorization from Lighthouse Creativity, except to the limited extent expressly permitted by law.


12. Feedback


Any ideas, suggestions, comments, recommendations, or other feedback submitted regarding the Services may be used, implemented, modified, adapted, or incorporated by Lighthouse Creativity without restriction and without any obligation of payment, attribution, or compensation.


13. Third Party Services, Links, and References


The Services may contain links to, references to, or integrations with third party websites, platforms, institutions, schools, universities, professors, experts, consultants, tools, or service providers. Lighthouse Creativity does not control and is not responsible for the availability, content, standards, policies, practices, decisions, actions, omissions, or results of any third party whatsoever.


Reference to any school, university, professor, institution, expert, opportunity, or outside provider does not constitute a representation that Lighthouse Creativity controls or guarantees admissions decisions, academic judgements, selection criteria, placement decisions, hiring decisions, or any other third party outcome.


14. Service Availability and Modification


Lighthouse Creativity reserves the right to change, limit, suspend, withdraw, discontinue, or modify any part of the Services at any time, with or without notice. No liability arises from interruption, unavailability, modification, withdrawal, delay, or discontinuation of any part of the Services.


15. Suspension and Termination


Lighthouse Creativity may suspend, restrict, or terminate any access to the Services, in whole or in part, at any time, with or without notice, where Lighthouse Creativity reasonably believes that a violation of the Terms has occurred, misuse has occurred, legal or operational risk exists, or protection of Lighthouse Creativity, users, or third parties requires such action.


A user may stop using the Services at any time. In the event of account deletion or termination, Lighthouse Creativity may retain information to the extent reasonably necessary for legal compliance, security, recordkeeping, dispute resolution, enforcement, fraud prevention, and legitimate operational purposes.


16. Disclaimer of Warranties


The Services are provided on an “as is” and “as available” basis. To the extent permitted by law, Lighthouse Creativity disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, availability, reliability, and suitability for any particular goal, objective, or circumstance. No representation or warranty is made that the Services will be uninterrupted, secure, error free, current, or appropriate for any specific user purpose.


17. Limitation of Liability


To the extent permitted by law, Lighthouse Creativity and its affiliates, officers, directors, personnel, contractors, consultants, representatives, licensors, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the Services or use of the Services.


Included among the excluded damages are loss of data, loss of opportunity, academic consequences, admissions outcomes, institutional decisions, business interruption, reputational harm, and financial loss. To the extent permitted by law, if liability is imposed notwithstanding the foregoing limitations, any total liability of Lighthouse Creativity arising out of or relating to a claim shall not exceed the amount actually paid to Lighthouse Creativity for the specific paid Service giving rise to the claim.


18. Indemnification


Each user agrees to defend, indemnify, and hold harmless Lighthouse Creativity and its affiliates, officers, directors, personnel, contractors, consultants, representatives, licensors, and agents from and against all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to User Content, use of the Services, breach of the Terms, misuse of the Services, or violation of law or third party rights.


19. Revisions to the Terms


Lighthouse Creativity reserves the right to revise, replace, or update the Terms at any time. Any revised version becomes effective upon publication on the website. Continued access to or use of the Services following publication of a revised version constitutes acceptance of the revised Terms.


20. Force Majeure


Lighthouse Creativity shall not be responsible for any delay, interruption, or failure in performance resulting from causes beyond reasonable control. Such causes include, without limitation, natural disasters, governmental actions, labor disputes, internet failures, hosting failures, platform outages, utility interruptions, cyber incidents, armed conflict, terrorism, epidemics, pandemics, public health emergencies, or similar events.


21. Entire Agreement


The Terms, together with the Privacy Policy and any separate written agreement expressly executed by Lighthouse Creativity and user, constitute the entire agreement governing access to and use of the Services.


22. Governing Law


The Terms shall be governed by and construed in accordance with the laws applicable to Lighthouse Creativity’s operations, without regard to conflict of law principles.
